$1.7 million recovered in bystander liability settlement
A Richland County, South Carolina plaintiff received a $1.7 million settlement for a bystander liability claim against a trucking company after a tractor-trailer fatally struck his mother on I-20 in December 2008. Fred Horlbeck reported the case, captioned Blake v. Harvin Transport Company, Inc. et al., in the March 2, 2009 edition of South Carolina Lawyers Weekly.
The article quotes the plaintiff’s lawyer, Dick Harpootlian, who explains that the settlement is believed to be the largest ever reported in South Carolina for a negligent infliction of emotional distress claim based on bystander liability.
