Whistleblower lawsuit against hospital settled for $17 million

A July 23, 2016 article by The State Newspaper’s John Monk reports a federal whistleblower lawsuit against Lexington Medical Center (LMC) has been settled for $17 million.

The case, brought by former LMC neurologist David Hammett, alleged the hospital illegally compensated employee physicians like Dr. Hammett for referrals to the hospital. The State reports that the details of the settlement will be released by the United States Department of Justice next week.

Dr. Hammett brought the suit on behalf of the United States government through the federal False Claims Act. The False Claims Act allows private individuals with knowledge of fraud to sue and, if successful, share in a portion of the government’s recovery.

Dr. Hammett was represent represented by Dick Harpootlian and Chris Kenney of Richard A. Harpootlian, P.A. and Wes Jackson, Jenkins Mann, and Shaun Blake of Rogers Lewis Jackson Mann & Quinn, LLC.
